OwTale Terms of Service

Welcome to OwTale. By creating an account or using our service, you agree to be bound by these Terms of Service. Please read them carefully. If you do not agree, please do not use OwTale.

1. About OwTale

1.1 OwTale is an AI-powered personalized children's storybook platform that enables families to create illustrated picture books featuring their children, complete with voice narration and optional hardcover printing.

1.2 Our service is available via the OwTale website and any associated applications.

1.3 We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice.

2. Accounts

2.1 You may sign up using a Google account or an email address. You must provide accurate and complete information.

2.2 You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

2.3 If you suspect unauthorised access to your account, notify us immediately at support@owtale.com.

2.4 Our service is intended for users aged 18 and over. Minors may use OwTale only under the supervision and with the consent of a parent or guardian, who accepts these terms on their behalf.

3. Children's Content and Safeguarding

3.1 You may create character profiles for children (name, age, gender, photo) to personalise their storybook. By submitting a child's information, you confirm that you are the child's parent or legal guardian and consent to its use for book creation only.

3.2 Children's personal data is handled in accordance with our Privacy Policy and applicable child data protection regulations, including the GDPR.

3.3 All AI-generated content passes through child-safety filters. You must ensure any content you submit or generate is lawful and appropriate. OwTale is not liable for user-modified content.

4. Payments, Orders, and Refunds

4.1 Certain features require payment (e.g., full digital book unlock, hardcover printing). Prices are displayed in your selected currency before checkout. By completing payment you agree to the purchase.

4.2 Digital books: Once AI generation is complete and payment confirmed, digital purchases are non-refundable, as the personalised product has been created.

4.3 Hardcover printing: Orders may be cancelled before printing begins. Once printing has started, refunds are not available except for verifiable print quality defects — in which case contact us within 14 days of receiving your order.

4.4 Redemption codes: Codes are single-use, non-transferable, and non-refundable once redeemed.

4.5 EU/EEA customers: Under EU consumer law, you have a 14-day right of withdrawal for digital content unless you have expressly waived this right by requesting immediate access to the generated content.

4.6 We issue electronic receipts. For VAT invoices, please contact us.

5. Acceptable Use

You must not use OwTale to:

5.1 Upload, generate, or distribute content that is unlawful, harmful, abusive, obscene, defamatory, or infringes any third-party rights;

5.2 Impersonate any person or entity, or misrepresent your affiliation;

5.3 Attempt to reverse-engineer, decompile, attack, or exploit the platform;

5.4 Use the service for bulk commercial content production or resell generated content to third parties without our written consent;

5.5 Violate any applicable law or regulation.

We may suspend or terminate accounts that violate these rules and may refer serious violations to law enforcement.

6. Intellectual Property

6.1 Your content: Photos, voice recordings, and other materials you upload remain your property. You grant OwTale a limited licence to use them solely to provide the service.

6.2 Generated books: Subject to full payment and compliance with these terms, you receive a personal, non-exclusive licence to use, print, and share the generated storybook for personal, non-commercial purposes.

6.3 OwTale IP: All trademarks, software, designs, and platform content (excluding user-submitted materials) are owned by OwTale. Unauthorised reproduction or commercial use is prohibited.

7. Disclaimer of Warranties

7.1 OwTale is provided "as is" and "as available". We do not guarantee that the service will be uninterrupted or error-free.

7.2 AI-generated stories and illustrations are inherently variable. We continuously work to improve quality but cannot guarantee any specific output.

7.3 We are not responsible for losses arising from your failure to maintain account security, network issues, or third-party service failures.

8. Limitation of Liability

8.1 To the maximum extent permitted by law, OwTale's total liability for any claim arising from these terms or the service shall not exceed the amount you paid to OwTale in the 12 months preceding the claim.

8.2 We shall not be liable for indirect, incidental, special, or consequential damages (including loss of data or profits) even if we have been advised of the possibility of such damages.

8.3 Nothing in these terms limits our liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded by law.

8.4 EU/EEA consumers: Statutory consumer rights under applicable law are not affected by these terms.

9. Changes to These Terms

9.1 We may update these terms as our service evolves. Material changes will be communicated at least 7 days before taking effect via email or an in-app notice.

9.2 Continuing to use OwTale after the effective date of updated terms constitutes your acceptance.

9.3 You may close your account at any time if you do not agree to updated terms.

10. Governing Law and Disputes

10.1 These terms are governed by the laws of the jurisdiction in which OwTale is incorporated, without prejudice to any mandatory consumer protection rights you have in your country of residence.

10.2 EU/EEA consumers: You may also bring claims before the courts of your country of residence. The European Commission's Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr.

10.3 We encourage resolving disputes amicably. Please contact us first at support@owtale.com before initiating formal proceedings.
